last night at 6am cops came in here and arrested me charged me with misdemeanors... pretty much with that on my record i cant graduate with a teaching degree... the story is that someone was out prowling and making obscene gestures late at night, well we had a suprise party for my roommates gf and they got in a fight, we played games till 3am and getting pissed drunk till i was the first to pass out asleep. so at 6 am they wake me up, take MY ROOMMATES sweatshirt and say its still cold, mind you we keep our heat real low to avoid high bills
then they said his cheeks look cold and woke him up and questioned him, i vouched for him, then the cop says after an hour that he thinks about it and it looked likes me, so i say im gonna cooperate and i go to this guys house, WEARING MY ROOMMATES SWEATSHIRT and the guy looks at me and says its a POSSIBILITY mind you i have shaved hair, so does 32 other guys on my team and countless other people in this world. so then the cop tells me to come clean and tells me to name the other 3 people involved, well i cant cause i wasnt there so he says tell me the other 3 people and ill charge with disorderly and your teaching career is saved, if you dont ill charge you with a misdeamor and your screwed. so i tell him its wiser if i say ok it was me, let me get the disorderly, but he says it doesnt work that way, im charging you with a misdemeanor. he says cmon tell me your guilty and youll be free. so i say the law says im innocent until proven guiltyand your basicly telling me im guilty till proven innocent by jepordizing everythign ive worked for in the last 5 years. THANK YOU.... mind you he told me a detective will be calling me and never read me my Miranda Rights when he gave me his card..... any advice on this, i didnt do a thing i have allabys from when the first inncodent happened but the other one i was sleeping here passed out drunk. but i sware i didtn do a thing and im being shafted. any advice, is it a winable case.

Hey Chris .... Soundest advice I could give you is to find a lawyer if this even progresses any further. I'm unsure of the costs involved, but sometimes you can get some advice for free from them.

Personal opinion ..... "possibly looks like him" won't carry any weight in the courts.

Be patient and see what happens.

Most of all though, find out the lessons learned from the entire situation. Don't want to kill your career before you even get started.

Sounds like a tough position to be in. Best to follow Sherm's advice, it seems the best way to go.

as long as you never admited it was you i don't see how they can do anything. it not the first time i hear similar stories about cops "forcing" people to admit they did something when they did not , most of the time they do it when they have no evidence whatsoever, i find the practice sickening, don't worry about it too much like i said before they try that tactic when they usualy have nothing. tell me you did it and you'll be free? yeah right. like sherm said it kinda looks like him means nothing to the courts and you shouldn't have a problem winning the case , none the less talk to a lawyer asap. also they can charge you with something but as long as you're not proven guilty it won't go on your record so it shouldn't hurt your teaching plans , anyway thats how i think it works.

Yes, get a lawyer. Also, I don't know what state you're in but a misdemeanor conviction usually will not preclude issuance of a professional license or certificate in most states, as long as the misdemeanor didn't involve sex crimes or crimes against children (which in most places would be a felony anyway). If you notice, job applications almost always ask for felony convictions. Felony convictions will almost always prevent you from getting a professional license; it depends on the offense. I think the cop involved was selling you a bill of goods there with the misdemeanor jazz. Sounds like he was just trying to save himself some paperwork. In most states misdemeanor records are expunged after 10 years in any case. But of course consult a lawyer. Good luck!

I wore a badge for 2 1/2 years. They haven't got anything on you or they would have taken you in right then and there!! It's all speculation. Even on the so-called witness' part. If I recall, he said it COULD be you. Well, it COULD have been anyone!
Like Eric said. Get a lawyer and don't talk to anyone about anything to do with the investigation.

Throw all the rocks you want, i wore a badge for 21 years..........I'll just echo what the others have said and tell you to consult/retain an attorney ASAP...the cop sounds like an asshat with a hand full of nothing. having you go to the witness for ID is what we called a *field show up*. If the wit couldnt have positively ID'd you there, then approval to book you would not have been granted. Also, I cant speak to your state specifically, but in Calif (I was LAPD) and most other states im aware of, a police officer cannot arrest you for a misdemeanor unless the crime was COMMITTED IN HIS/HER PRESENCE. It must be a private persons arrest.

dude, move out to Cali, they'll let anyone teach out here......there's been plenty of scandals with convicted felons teaching out here.....a misdemeanor is nothing.
